Greenberg Gross Files Lawsuit Against Santa Margarita Catholic High School Over Alleged Attack on Student-Athlete by Teammates
Greenberg Gross has filed a lawsuit against Santa Margarita Catholic High School on behalf of a 15-year-old sophomore football player who was ambushed and attacked by teammates in the school’s locker room. During the incident, the student was tackled, held down by several players, and subjected to a violent assault of a sexual nature, while other players cheered and banged on lockers.
This unprovoked attack is described as part of a pattern of unchecked aggression within the football program that the administration has allegedly allowed to persist, despite repeated instances of similar incidents affecting other students. In an email sent directly to our client, Principal Cheri Wood acknowledged that “at least nine” students were subjected to similar incidents.
Further allegations describe a culture where players are pressured to participate despite injuries, often against medical advice. The school’s trainer, Mike Burns, allegedly mocked the plaintiff’s medical documentation, dismissing it as a “weak-ass note” and discouraging players from seeking outside medical assistance.
Greenberg Gross partner Brian L. Williams stated, “These are not isolated incidents involving teenage boys, but rather the product of an environment shaped by the coaching staff and administration. Every student deserves a safe school environment, and we are committed to seeking accountability and change.”
The lawsuit, filed against both Santa Margarita Catholic High School and the Diocese of Orange, seeks damages for negligence, negligent supervision, and intentional infliction of emotional distress. The school has stated it is fully cooperating with authorities and that its investigation remains ongoing.
